Common Questions
Is W-8BEN the same as W-8BEN-E?
No. W-8BEN generally documents an individual foreign beneficial owner; W-8BEN-E generally documents an entity. Other forms may apply depending on the recipient and income.
Are W-8 forms sent to the IRS?
Generally, the recipient gives the appropriate W-8 form to the requesting withholding agent or payer, which retains it. It is not routinely sent directly to the IRS by the recipient.
How long is a W-8BEN valid?
Generally, from signature through the last day of the third succeeding calendar year, unless a change in circumstances makes it incorrect. Exceptions and other form-specific rules require review.
Does a W-8 form automatically remove withholding?
No. Documentation is one part of the analysis. Payment type, source, recipient status and any valid exemption or treaty claim still matter.
